<국문초록>
2008년 이른바 광우병위험 미국산 쇠고기 전면수입을 반대하는 국민들의 집회 및 시위가 있었다. 집회 및 시위 현장의 주변 상인들과 경찰청 등이 주도하여 집회주최자 및 참여자 등을 상대로 다양한 방식의 민사 손해배상청구의 소를 제기하였다. 하지만 이와 같이 집회주최자에게 민사책임을 묻는 것은 매우 신중한 검토가 필요하다. “상인소송”과 달리 “경찰청 소송”의 경우는 특수 쟁점이 있는데, 경찰청이나 경찰공무원이 공무집행상 입은 손실에 대하여 불법의 원인을 제공한 자에게 일반적으로 ‘민사상 불법행위책임’을 물을 수 있는가 하는 문제이다.
이 글에서는 2008년 이른바 광우병위험 미국산 쇠고기 전면수입을 반대하는 국민들의 집회 및 시위와 관련된 민사소송의 개요와 주요 쟁점을 간략히 살펴본 후, 그 쟁점 중에서 주로 경찰공무원이 집회 및 시위의 진압이나 수사과정 등 관련 공무를 집행하는 과정상 입은 손실에 대하여 불법의 원인을 제공한 자에 대하여 일반적으로 민사상 불법행위책임을 묻는 경우의 문제점을 정리한다. 이어서, 이 문제와 관련된 영미법상의 법리로서 municipal cost recovery rule 및 fireman's rule 등 몇 가지 중요한 법리를 소개하고, 우리에게 주는 시사점을 생각해 본다.

<Abstract>
Legal Issues of the Korean Government's Tort Claim Regarding the Police and Police Officer's Damages Against Organizers and Participants of Assemblies and Demonstrations

In 2008, a nationwide dispute was raised when the Korean government decided to open its domestic beef market to the United States, thus disregarding the health risks of BSE (bovine spongiform encephalopathy). Millions of people assembled at the Seoul Plaza and demonstrated against the government's policy. As a response, the Korean government instituted a lawsuit against the organizers and participants of the assemblies and demonstrations. The Korean government claimed damages, including the extra expense that resulted from organizing police activities, as well as the medical costs of the police officers who suffered during the demonstrations.
This article discusses the tort law issues, specifically with regard to whether the municipal cost and the expenses regarding the organized police activities should be recovered by the court. The author presents an analysis on the municipal cost recovery rule and the fireman's rule, thereby comparing the common law with the Korean law. In conclusion, the author proposes a perspective that balances between various values of the law including private and public interests, the role of the state, and the constitutional aspect of the assemblies and demonstrations.
