유엔 강제실종협약의 채택과 한국사회의 과제
<국문요약>
2006년 유엔 총회에서 채택된 ‘강제실종으로부터 모든 사람을 보호하기 위한 국제협약’은 강제실종의 처벌과 방지를 두 축으로 이에 관한 인권기준과 보호절차를 마련한다. 국가가 사람을 체포, 구금한 다음 이를 인정하길 거부하거나 행방을 감추어 법의 보호 바깥에 놓을 경우 인정되는 강제실종은 인도에 반한 범죄로서 과거 군사정권의 전유물에 그치지 않고 오늘날에도 테러와의 전쟁 등 세계 곳곳에서 자행되고 있다. 강제실종협약은 무엇보다 강제실종을 하지 않을 국가의 의무를 구체화하여 실종조사, 책임자 처벌과 구금에 관한 기록 유지를 요구한다. 협약은 또한 진실을 알 권리를 비롯하여 강제실종 피해자들의 정보요구권과 배상의 권리를 인정한다. 협약의 이러한 성과는 모든 국제․국내 인권기구에 의해 공유되어야 하며, 한국은 조속히 이를 비준하고 처벌법규를 포함한 협약이행을 위한 조치를 취하여야 한다. 또한 협약발효 이전의 사건에 대하여도 협약을 적용할 것을 촉구한다.

The United Nations Convention on Enforced Disappearance and Its Challenges to the Korean Society

The International Convention for the Protection of All Persons from Enforced Disappearance, adopted by the UN General Assembly in 2006, sets out human rights standards and enforcement mechanisms for the punishment and prevention of enforced disappearances. Enforced disappearance occurs where the State arrests or detains persons while denying its knowledge or refusing to disclose their whereabouts, thereby putting them out of the protection of the law. Enforced disappearance has not been the sole monopoly of past military dictatorships, but is still being committed worldwide as in the War on Terror. The Convention, first of all, confirms the obligation of State Parties not to practice enforced disappearance, requiring them to investigate, punish its perpetrators and make records on detentions. The Convention also affirms the right to know the truth as well as the right to information and reparation of the victims of enforced disappearance. The achievements of the Convention should be pursued in the practice of both international and national human rights institutions. The Korean Government should proceed to its ratification and take national implementation measures including related criminal legislation. It should also declare the de facto application of the Convention to the events arising before its entry into force.
