<국문초록>
우리 사회에서는 지배를 위한 폭력이 일상화되어 있다. 시위를 하던 시민이 경찰 의 물대포에 쓰러져 사경을 헤매고 있고, 기업에서는 노동조합활동을 파괴하려는 조 직이 개입하여 일대활약하고 있으나 국가는 방관하고 있다. 법률의 취지나 내용을 위반하는 시행령에 대해서 국회는 뾰족한 대책을 마련하지 못하고 있으며 이를 통 하여 국회는 행정부의 폭력 행사를 방관하고 있다. 국가는 폭력수단을 정당하게 독점하는 존재이면서 이를 통하여 폭력으로부터 인 간의 자유와 권리를 보장하는 역할을 수행한다. 그러나 국가는 적절한 내용의 법률 을 만들지 않을 경우 폭력을 방치하거나 조장하는 결과에 이를 수 있다. 국회는 힘 의 불균형관계에서의 시정 노력을 제대로 하지 않음으로써 강자의 폭력행사를 법적 으로 정당화하는 역할을 하고 있는 것이다. 그럼 점에서 폭력에 대하여 권력의 주도 권을 확보해야 한다. 이 글에서는 집회 및 시위에 관한 법률, 국가공무원법이나 용역경비업법 등을 중 심으로 구체적 입법이 폭력의 조장, 방관 등에 어떻게 관련되어 있는지를 밝히고 그 에 대한 해결방안을 모색하고 있다.

<Abstract>
The Violence of Law and Legislation in the Violent Society

We are now confronting the violent society. Even the legitimate state power can be recognized as a violent organization, if it does not control the violence regarding the interest of the power elites, aggravate it by law and legislation, or if it cannot protect the life and safety of citizens from threat and danger. The state power has the essential character of violence, if it is not legitimated by the consent of citizens. A citizen has been in the state of coma for months, after he was shot to the ground by a police water cannon last year. It was because of the abuse of police power, the violence exercised by the state. The abuse of water cannons cannot be checked by the Act on the Performance of Duties by Police Officers. The use of water cannons has its foundation in the enforcement rule, not in the act. The legislature has the duty to make laws to guarantee the human rights in accordance with the constitutional law. However, the Korean National Assembly does not try to make the law which would effectively control the action of riot police, or try to revise the articles regarding the restriction of political activities of public officials and school teachers. The violence is caused by the defects in the law. I examined the various situations of the violence caused by the law and legislation in the Korean society, tried to investigate the cause and find a way to solve it.
