<국문초록>

이 글은 한반도대운하사업의 추진을 위한 법적 지원체계로 정부가 구상하고 있는 한반도대운하특별법안(이하 구상법률안)의 헌법적 문제점을 고찰함을 목적으로 한다.

먼저, 구상법률안은 대운하사업이 국토종합계획에 반영하지 아니한 채 특별법 형식으로 추진된다는 점에서 국토계획법체계에서, 운하가 습지보전지역이나 상수원보호구역 등에 건설된다는 점에서 환경관련법체계에서 일탈하고 있다. 그런데, 체계일탈의 필요성(불가피성)이 인정되지 아니하며 체계일탈로 인한 이익이 불이익보다 크지도 않다는 점에서 구상법률안은 체계정당성 원리 및 비례원칙에 위반될 소지가 크다.

또한, 구상법률안은 운하건설의 신속성을 보장하기 위하여 환경영향성 및 재해영향성 검토절차를 간소화하는 특별규정을 둘 수밖에 없는데 이는 환경국가원리(사전배려원칙) 등에 위반될 수 있다.

마지막으로, 대운하건설계획에는 기본권적 가치 및 헌법원리와 관련성을 지닌 이익들로 형량과정에 포함되어야 할 이익들이 누락된 “형량흠결의 하자”가 존재한다. 따라서 구상법률안이 입법된다면, 이는 법치국가적 형량명령에 위반되는 입법으로 평가될 수 있다.

<Abstract>

The Review of the Special Legislation Draft for Korean Peninsula Grand Canal Project from the Aspect of Constitutional Theories

The purpose of this article is to examine the constitutionality of “the Special Legislation Draft for Korean Peninsula Grand Canal Project”(referred to as “the Draft” below) as a legal system supporting for advancement of Korean Peninsula Grand Canal Project(referred to as “the Grand Canal Project” below).

First, the Draft deviates not only from the national land law system in that the Grand Canal Project will be planned to proceed through the form of a special legislation, not to be reflected in the ‘comprehensive national land plan’, but also from the environmental legal system in that the grand canal will be constructed in conservation areas such as ‘wetlands conservation area’ and ‘water supply protection areas’. Considering that the necessity for deviation from the established systems can not be admitted, and that the disadvantages arising from the deviation outweighed the benefits therefrom, the Draft will probably be determined to violate ‘system-consistency’ principle and ‘proportionality’ principle

Secondly, the Draft, to guarantee the speedy construction of the canal, inevitably would have some special provisions simplifying the procedures for the preliminary review of the influences of the canal project on environment and disaster, which is to be judged as infringing the environmental state principle.

Finally, there are defects of ‘lack of balancing’ in that the legal interests related to constitutional values and principles are slipped out in the process of balancing in the grand canal construction plan. Therefore, if the Draft becomes a law, it would be seen as violating the ‘balancing-mandate’ under the rule of law principle.
