<국문초록>

본 연구는 한반도대운하 건설사업과 한반도대운하건설특별법 구상이 헌법, 국토기본법, 국토계획법에서 규정하고 있는 국토의 계획적 관리의 이념과 어떻게 상충되는지를 분석하여 이 구상의 문제점을 제기하는 데 목적이 있다. 이를 위해 한반도대운하에 대한 대통령후보 공약과 한반도대운하연구회가 발간한 서적, 국토해양부의 보고문건에서 나타난 한반도대운하 구상을 대상으로 한반도대운하건설구상과 한반도대운하특별법이 헌법과 국토관련 법률을 어떻게 위배할 수 있는지를 평가하였다.

분석결과, 한반도대운하구상과 한반도대운하건설특별법 구상은 국토관련 계획체계의 일관성을 훼손하며 수도권관련 규제의 완화를 초래하여 수도권 집중을 가속화할 뿐만 아니라 생태계의 훼손과 과도한 개발의 확대를 낳을 것으로 밝혀졌다. 이러한 문제점을 무시하고 한반도대운하사업을 위해 특별법을 제정하는 경우 개별법의 제정정신을 근본적으로 훼손함으로써 또하나의 위헌법률을 낳을 것임을 밝혔다.

본 연구는 국토의 지속가능하고 균형있는 발전을 위해서는 한반도대운하구상을 전면 재검토해야 하며, 이를 추진하기 위한 한반도대운하건설특별법 구상도 철회되어야 한다는 점을 주장하고 있다.

<Abstract>

The Problems of the Draft Special Act on the Construction of The Great Korean Canal from the Viewpoint of the Planned Management of Territory

This study is aiming at shedding light on the problems and limitations of the Great Korean Canal Project and the Draft Special Act on the Construction of The Great Korean Canal by analyzing how the Project and the Draft would violate the principle of planned management of territory.

Such analyses were carried out, based on the Presidential election pledges of President Myung-Bak Lee, books from the Great Korean Canal Research Association and Reports by the Ministry of Land, Transportation and Maritime Affairs, to prove how plans for the construction of the Great Korean Canal and the Draft Special Act would violate the constitution as well as current laws on management of territory.

Major findings obtained in the analyses of the Great Korean Canal Project and The Draft Special Act on the Construction of the Great Korean Canal were as follows:

The Project and the Draft have significant potential to

(a) destroy consistency and relevancy of planning systems in the management of territory;

(b) further deregulate the Seoul Metropolitan Area, thereby accelerating the process of concentration of Seoul Metropolitan Area; and

(c) result in the destruction of environment and further expansion of excessive development.

Furthermore, results in the current investigation show that the Draft, if enacted, would breach the purposes of individual laws, hence doomed to be unconstitutional.

The results suggest that the Great Korean Canal Project be re-appraised and the Draft Special Act on the Construction of the Great Korean Canal be withdrawn for the purpose of the sustainable and balanced development of territory.
