<국문초록>

종교재단이 설립ㆍ운영하는 종교학교에서의 학생에 대한 종교교육은 강제적인 경우가 많다. 지난 몇 년 동안 중등학교에서의 종교교육의 문제점과 관련하여 논란을 야기한 서울대광고 강의석씨 사건에 관하여 서울고등법원은 대광고의 종교교육강제, 퇴학처분에 의한 불법행위로 인한 손해배상청구소송에서 종교교육이 강제적이었다고 볼 수 없고, 교육부고시위반이나 종교교육거부로 인한 퇴학처분 역시 불법행위가 성립하지 않는다는 이유로 원고패소판결을 선고하였다. 이 판결은 원고가 겪은 종교교육의 심각한 현실을 제대로 인식하지 못하고 있다는 점, 판결문을 헌법이론으로 화려하게 치장하고 있으나 논리전개에 아무 관련성이 없거나 결론과는 모순되는 내용이라는 점에서 국민과 소송당사자를 설득하는 판결문으로서는 결격이라 할 수 있다. 종교의 자유가 상위의 기본권이라는 점을 인정하면서도 그 침해의 현실에 대한 판단은 너무나도 안이하며, 종교교육 거부로 인한 퇴학처분에 관해서도 형식적이고 피상적인 논리로 일관하고 있다. 과연 소송의 피고가 기독교 학교법인이 아니라 기독교가 싫어하는 특정종파에서 운영하는 학교법인이고 원고가 기독교신자였다 해도 이 판결을 한 법원은 동일한 판결을 선고하였을까?

다원종교사회인 한국사회에서 종교교육은 필요하다. 그러나 필요한 것은 특정종교의 신자를 만드는 교육이 아니라 종교일반과 타종교에 대한 이해와 관용이다.

<Abstract>

Freedom of Religious Education of the School and Freedom of Religion of the Students at Religious Schools

- A Comment on a Case of Seoul High Court(2007na102476)-

The Seoul High Court(“High Court”) overruled the decision of the District Court which admitted the claim of the plaintiff(Gang, Eui-seok), who maintained that he had been forced to participate in the rituals and religious education at the defendant’s school(Daekwang High School) and was expelled from the school. The High Court denied that the plaintiff had been forced to participate in the rituals and other religious education, and held that even though he was expelled by the wrong discipline, it would not constitute torts because the teachers of the disciplinary committee were not experts in law.

I think that the judgement of the High Court on this case is absurd, naive and illogical. First of all, the High Court was very naive because it neglected the seriousness of the violation of religious freedom at religious schools, though the High Court admitted the religious freedom as a fundamental right. The students did not agree to the religious education of the school because the students and their parents did not have the right to choose the school when they entered schools. They were alloted to a certain school regardless of their desires. Moreover, it cannot be accepted to educate students in religion more intensively than in the religious organizations. Under these conditions, the fact that the school had asked the students to participate in the rituals, and had regarded the students who didn’t participate in the rituals as absent, means that the school had forced the students to do it. Even though the members of the disciplinary committee were not the experts in law, they could and should have known the facts and seriousness of the mandatory religious education which violates the religious freedom. Nonetheless the High Court denied the responsibility of the defendant.
