<국문초록>

‘인간의 존엄’은 현행 헌법의 중심 이념이다. 그러나 과연 이러한 헌법의 이념이 현실에서 얼마나 충족되고 있는지는 의심스럽다. 특히 한국의 노동 현장에서 ‘인간의 존엄’은 장식적 의미에 머물러 있다. 최근 문제가 되었던 ‘갑을오토텍’ 사건을 돌이켜 보면 ‘인간의 존엄’이라는 이념은 노동자에게는 해당되지 않는 것처럼 보인다. ‘갑을오토텍’의 사주는 노동자와 노동조합을 탄압하기 위하여 치밀하게 시나리오를 준비했다. 그리고 그 시나리오대로 진행되는 노동탄압의 과정에서 노동자들은 ‘인간의 존엄’을 박탈당했다.

헌법상 ‘인간의 존엄’이 단순히 이념적 지향을 밝힌 것에 머무르지 않고, 실체를 가진 기본권의 전제로서 기능하고 있는지를 판단해야 한다. 노동자들이 향유해야 할 ‘인간의 존엄’의 기준이 무엇인지도 명확해야 한다. 여기에서 노동정치의 재구조화와 재작동이 필요하다. 이 과정에서 우선 ‘인간의 존엄’이 노동조건의 기준이 될 수 있도록 제도를 정비해야 한다. 두 번째로 노동 주도의 대안전략을 수립하고 이를 근거로 계급적 연대를 실천해야 한다. 세 번째로 노동의 신성함이라는 허구를 극복하고 노동 자체의 의미에 대한 새로운 사회적 합의를 구성해야 한다.

마지막으로 좌파의 입장에서 기회의 평등이 아닌 결과의 평등이라는 의제를 다시 끌어 올려야만 한다. 이렇게 함으로써 헌법의 이념인 ‘인간의 존엄’은 새로운 의미를 가지게 될 것이다. 향후 기술의 진보로 인하여 노동시장의 급격한 변화가 예상되는 상황에서, 노동정치의 복원과 ‘인간의 존엄’ 이념의 재구성은 시급한 과제가 된다.

‘Human dignity’ is the central ideology of the current Constitution. However, it is doubtful if this constitutional ideology is implemented in reality. Especially, ‘Human dignity’ remains a decorative meaning on the matters of labour in Korea. ‘KB Auto-Tech’, Judging from the recent incident of the idea of ‘human dignity’ does not seem to work for the workers. The owner of ‘KB Auto-Tech’ carried out plan to suppress its workers and labor union. As the result of the oppression, the workers were deprived of ‘human dignity. In order for the ideology of ‘human dignity’ to work in reality, it must not be remained as a mere theory. It is necessary to judge whether ‘human dignity’ can be put into practice as fundamental right. The criteria of human dignity should be defined so that workers can enjoy their dignity as humanbeing. Here, labor politics needs to be restructured and reactivated. In this process, firstly, the institutions should be reformed so that ‘human dignity’ becomes the standard of working conditions. Secondly, labor-led alternative strategies should be established and class solidarity should be practiced based on this. Thirdly, we must overcome the fictitious sacredness of labor and construct a new social consensus on the meaning of labor itself. Lastly, from the standpoint of the left, we must raise the agenda of equality of results, not equal opportunities. By doing this, the ‘human dignity’, the ideology of the Constitution, will have a new meaning. It is urgent to restructure the labor politics and reconstruct the 'human dignity' ideology when the labor market is changing rapidly by advances in future technology.
