<국문초록>

 

정치적 표현의 자유는 선거의 전제이며, 정치적 의사를 형성하고 이를 표현하는 데 있어서는 정도를 벗어난 제한이나 간섭이 가해져서는 아니 된다. 그런데 선거에서의 자유는 선거인의 결단의 자유에 간섭하는 직간접적인 강제나 압력 등이 완전히 존재하지 않은 경우를 의미하는 것이므로, 선거와 관련된 선전 등을 통하여 영향력을 행사하려 하는 것은 여기에 반하는 것이 아니라 할 것이다. 이러한 판단은 선거인의 의사 수령능력과, 수령한 의사를 적절하게 활용하여 자신의 정치적 의사를 형성하고 이를 표현할 수 있는 능력을 존중하고 있는 것이다. 표현의 자유와 관련된 제 이론들에 비추어 보았을 때에도 이러한 선거운동의 자유를 보장하는 것은 민주주의를 천명하고 있는 정치체제에서의 주요 과제임이 분명해진다.

그러나 일본과 우리나라는 선거의 공정을 정당화의 사유로 하여 법령이 허용하는 방법을 제외한 다른 모든 선거운동을 금지 또는 제한하는 방식으로 선거제도를 운영하고 있다. 특히 개인이 정치적인 의사를 표현할 수 있는 가장 기본적이며 자연스러운 방식인 호별방문을 통한 선거운동을 상시일률적으로 금지하고 있다는 점에서 양국의 선거제도에는 심각한 문제가 있다.

이 글은 이를 문제로 삼아, 일본과 우리나라의 공직선거법에서 호별방문을 상시일률적으로 금지하고 있는 규정의 정착 과정과 그 문제점에 대하여 살펴보았다. 이를 바탕으로 생각건대, 호별방문금지규정을 두고 있는 일본과 우리나라의 공직선거법은 선거인의 정치적 표현의 자유 및 정치의 주체로서 선거인의 지위를 인정하지 않고 있는 것으로 보인다. 그리고 해당 규정의 정착 과정에서 나타나고 있는 것처럼 일본과 우리나라에서 정치적 표현의 자유는 제국헌법체제 수준에서 거의 발전하지 못하였고 오히려 퇴보하기까지 하였다.

선거의 공정을 정당화의 사유로 하여 선거운동을 일정 제한할 수 있다손 하더라도, 이것이 정치적 표현의 자유의 본질적인 부분까지 제한하는 방향으로 나가서는 결코 아니 된다. 이러한 점에서 호별방문을 상시일률적으로 금지하고 있는 규정은 위헌의 소지가 있다 할 것이다.

A Brief Review on the History and the Unconstitutionality of a Total Ban on Door-to-door Canvassing

Freedom of speech is a necessary prerequisite in the election, and undue restriction or interference should not be placed in forming and expressing political opinion. However, election campaign does not go against freedom of speech in the election because this principle means that coercion or pressure does not exist, which interferes directly or indirectly in making up elector’s mind. This is a valid inference that has due regard to elector’s capability of receiving, forming, and expressing political opinion. Moreover, it is a essential task of democracy to guarantee freedom of election campaigning in view of various theories related to freedom of speech.

In Japan and Republic of Korea, nevertheless, election systems work restrictively by reason of fair election. There are many ways of election campaigning which are not allowed by Election Act. Above all, these election systems have a serious problem because door-to-door canvassing is prohibited, which is the most fundamental and natural way to interchange political opinions.

Paying attention to this matter, this paper looks at the history and the unconstitutionality of a total ban on door-to-door canvassing in Japan and Republic of Korea. Based on these, it is suspected that Public Offices Election Act (Japan) and Public Official Election Act (Republic of Korea) do not accept freedom of speech of electors or elector’s status as a main agent of political activity. Furthermore, freedom of speech and the political standard in Japan and Republic of Korea have been stagnant, or rather regressed from the period of the Empire of Japan.

Even if some part of election campaigning is possible to be restricted with a view to achieving fair election, it is never allowed to restrict an essential part of freedom of speech, in particular related to political matters. In this regard, a total ban on door-to-door canvassing is unconstitutional.
