<국문초록>

 

박근혜가 탄핵되기 직전이다. 넉 달 가까이 촛불을 든 천만 이상의 시민들이 국회를 압박하여 현재의 상황을 이끌어냈다. 그러나 박근혜의 탄핵이 끝이 되어서는 안 된다. 시민들이 광장에서 거의 4개월간의 촛불시위를 통하여 요구했던 것은 단순히 박근혜(정권)의 퇴진에 그치는 것이 아니었다. 시민들은 박근혜를 중심으로 한 현 체제의 청산과 새로운 국가의 설계를 원하고 있다. 그렇다면 헌법의 변경, 아니 새로운 헌법의 제정은 피할 수 없는 과제이다.

유신헌법과 군사독재의 잔재 청산은 현 체제의 청산을 위한 최우선적 과제이지만, 우리가 새로운 국가의 설계를 이야기하는 이상 그것에만 머물 수는 없다. 과거의 청산과 현재의 진단 그리고 미래의 설계가 동시에 진행되지 않는 한 촛불은 혁명으로 나아가지 못할 것이다.

이와 관련해서 결코 부정할 수도 없고 또 결코 잊지 말아야 할 하나의 사실은 정치인이나 법률가의 상상보다 민중의 상상력이 훨씬 더 풍부하다는 것이다. 그 민중의 상상력을 동원하고 활용할 수 있는 방안을 우리는 반드시 찾아내야 한다. 그러므로 우리는 새로운 헌법, 새로운 미래, 새로운 민주공화국의 설계를 위하여 다시금 광장으로, 촛불로 돌아가야 한다.

그러면 우리는, 촛불시민들은 무엇을 위하여 이렇게 오랫동안, 이렇게 강렬하게 광장에 모여서 외쳤던 것일까? 그것은 우리가 2008년 이후 늘 광장에서 불렀던 노래가 말해준다. 말하자면 우리 촛불시민이 원했던 것은, 그리고 지금도 절실히 원하고 있는 것은 대한민국이라는 나라가 민주국가인 동시에 공화국이 되고 그 속에서 주권자인 국민이 주권을 온전히 행사하는 것이었다. 이것은 국민에 의한 주권 회복이고 주권 회수이며 대의의 철회를 의미하는 것이다.

그러면 대한민국을 민주공화국으로 만들고 국민주권을 실현시키기 위해서는 무엇이 필요한가? 촛불시민들이 광장에서 요구했던 것은 1) 국민소환제와 같은 직접민주주의, 2) 직접민주제를 전제로 한 대의민주제의 정상화, 3) 권력분립과 이를 통한 견제와 균형이 실질적으로 작동하는 정치 구조의 수립, 4) 재벌중심 경제체제에서 노동 중심 경제체제로의 재편, 그리고 5) 이를 통하여 기본적 인권이 온전히 실현되는 것이 아닐까 싶다.

이러한 작업은 결코 여야 정치세력에게 맡겨질 수 없다. 그 순간 촛불은 실패한 혁명이 되고 말 것이다. 필요한 것은 광장의 촛불을 체계화된 민회로 조직해내고 이를 통하여 시민들의 요구를 헌법적 및 입법적 요구들로 체계화하여 정치권력에 강제하는 것이다.

<Abstract>

 

Candle Light Protest & Constitution Building

Park Geunhye is on the verge of being impeached. A series of ever-growing million-strong protests since late October, 2016 forced the Parliament to finalise the impeachment process. But the impeachment of Park can not be the end. What more than 10 million citizens have requested through candle light demonstrations for nearly four months is beyond her impeachment. They want liquidation of the ancient regime and building a democratic republic of their own design. If so, the building of a totally new constitution, not just alteration or revision of the current constitution, is necessary.

Though elimination of the remnants of the military dictatorship including the Yushin Regime takes precedence over any other tasks, we can not stop there. Candles can proceed to the revolution only when liquidation of the past, diagnosis of the present, and design of the future go together. Regarding these, it should be borne in mind that imaginative power of the people is far richer than that of politicians or lawyers, and that we have to draw up the plan to find out and mobilize and utilize the imaginative power of the people. Therefore we need to return again to the candles in the agora.

What have we claimed in the agora, for such a long time and so strongly? The song “Art. 1 of Korean Constitution” we have enjoyed singing since 2008 answers the question. To put it in plain terms, what the citizens with candles have been demanding is a democratic and republic country where people, the sovereign, can and do fully exercise their sovereignty. This means restoration or recovery of the sovereignty, and withdrawal of representation, both by the people.

What is necessary to build a democratic republic and to realize the principle of people’s sovereignty? Citizens’ requests can be summarized as follows: First, introduction of direct democracy including recall system; second, normalization of the representative system; third, establishment of a political construction in which the system of separation of powers and checks and balances substantially functions; fourth, restructuring the chaebol-centered economy into a labor-centered one; and finally full protection and promotion of fundamental human rights.

These tasks can not be assigned to old political circles. It is necessary to organize the candles in agora into a citizens’ assembly, and thereby to systematize the people’s demands into a concrete plan for constitutional and legislative reform. Then we strongly exert pressure on the main stream political parties to accept the demands and to institutionalize the plan. Until then, we must and will keep raising the candle light higher and brighter.
