<국문초록>

 

사법개혁에 있어 가장 중심이 되는 이념은 사법의 독립성과 민주성이다. 지난 권위주의체제하에서 사법체계를 왜곡시켰던 것이 사법에 대한 외부적인 압력과 간섭이었다고 한다면, 오늘날 우리 사법부는 제왕적 대법원장을 중심으로 하는 내부적 권력관계가 시민사회의 법감정과 동떨어진 법판단을 이끌어내는 양상을 보인다. 사법의 독립이라는 헌법상의 요청을 어느 정도 이루어내는 동안 시민사회에 대한 사법관의 지배체계가 새로이 등장하고 있었던 것이다.

자유주의적 정치세력이 신군부세력과 연합하여 구성한 87년헌법체제하에서의 사법부는 그에 상응하는 한계를 가진다. 그것은 법적 안정성과 예측가능성이라는 명분을 앞세운 보수적 이해의 방파제로, 재산권보장체제를 완비하는 첨병으로, 그리고 탈규제화를 정상화하는 담론기구로 기능하면서 법의 형식성에만 초점을 맞춘 판결로 일관한다.

이에 이 글은 2016년 가을부터 진행되었던 촛불정국에서의 요구사항들을 정리하고 이를 중심으로 사법개혁의 방안을 정리해 보았다. 특히 이 글은 사법부의 개혁방안과 관련하여서는 유럽에서 흔히 채용되어 있는 사법위원회 제도를 제안한다. 사법의 독립성과 민주성(혹은 책무성)을 동시에 충족할 수 있는 사법행정체제로서 법관과 국민―혹은 국민의 대표가 공동운영할 수 있는 여지를 마련한다. 그리고 이러한 통로를 통해 시민들이 유효하게 사법과정에 참여하는 민주적 사법을 구성해 낼 수 있을 것이라 보았다.

<Abstract>

 

“Candlelight Rallies” and Accountability of the Judiciary

The “Candlelight Rallies” of 2016-7 have revealed the limitations of the so-called ‘1987 System’ based on the Constitution of 1987. This essay aims to analyse its limitations from the perspective of judicial independence and accountability with some proposals to reform the Korean judiciary into more accountable one. Independence and democracy of courts are the major two factors that must be taken into consideration when discussing the reform of the judiciary. Under the authoritarian military regime, the judiciary had been so much violated by external interruption and intervention of dominant political powers. Today, while the judicial branch has apparently achieved significant level of independence owing to political democratization, it has two major problems as well: “Imperial Chief Justice” and Juristo-cracy.

This article analyses several factors of the Korean judicial system that have resulted in problems as follows: immense power vested to the Chief Justice including power to appoint judges, the National Court Administration which oversees and controls every judges and judicial members, and judge’s fierce competition for promotion to higher position. A judicial reform program should provide not only some solution against these factors, but also additional alternatives to meet the strong demand for democratization of the judiciary which has been revealed in the candlelight rallies of the past winter. This article proposes a council for judiciary system that is commonly employed in Europe. Considering european experience, this article contends that such a council membered by representatives of judges and the National Assembly can simultaneously satisfy the – sometimes conflicting – principles of autonomy and accountability of judiciary.
