<국문초록>

 

이 글은 현행 헌법 체제 하에서 결선투표제를 도입하는 것이 가능한지의 문제를 그동안의 논의들에 대한 비판적 분석을 바탕으로 헌법해석학의 관점에서 제시해 보았다. 이 문제는 촛불집회 이후 정치·사회체제의 개혁을 위한 과제 중의 하나로 우리 정치체제의 다원화, 민주화를 추구하는 현행헌법의 취지에 비추어 중요한 의미를 가진다. 특히 제2차투표의 과정에서 이루어지는 타협과 조정, 연합과 연대의 기회는 절대다수제가 공화적 이념에 봉사하는 것임을 잘 보여준다. 이에 이 글은 당선자결정방법을 헌법에 규정했던 52년 헌법과는 달리 그것을 선거법이라는 법률의 차원으로 바꾸었던 62년 헌법의 구조를 살펴보면서 이렇게 발생한 헌법의 침묵(, 무규정)은 절대다수제를 금지하는 것이 아니라 오히려 그 선택여부를 입법자에게 위임한 것으로 해석하는 것이 보다 헌법합치적 결과를 야기할 것이라고 보았다.

Presidential Run-Off System and 
the Constitution

This essay is to examine the legal possibility of introducing some run-off system for the presidential election under the current Constitution. There have been lively debates on the political desirability of adopting such system into Korean politics, but few researches on the constitutional aspects of the issue. This essay reviews the debate from several points of view, esp. from the viewpoint of constitutional history, which has rarely been taken appropriate attention from the scholars arguing against the constitutionality of such system.

By criticizing such argument, this essay tries to re-interpret the absence of the constitutional provision on the run-off system which has been unchanged from the Constitution of 1962. In sum, whether or not to introduce this system is not a constitutional matter but a matter of legislators' will. It is the advantage of the run-off system that the system supports active politicalization of public sector in Korean society, one of the mandates of the Constitution. The system also promotes democratization in Korean politics. That is the another reason that this essay argues for the constitutionality of the run-of system.
