<국문초록>
오늘날 법 연구와 법 실천을 지배하는 것은 조문과 판결에 대한 실증주의적 태도이다. ‘전문가 바보’인 법률가들은 ‘법 앞에’ 서성이기만 할뿐 법문 밖 세계 를 넘보지 못한다. 전문 직업학교인 로스쿨의 등장으로 이러한 경향은 심화되 고 있다. 이 글은 도덕・법철학자인 마사 누스바움의 <시적 정의>를 읽고 필자 의 느낌을 적은 것이다. 누스바움은 기술적 이성만이 아니라 합리적 감정이 개 입하는 법해석을 제안한다. 법적 판단은 문학적・시적 심판이기도 해야 하며, 이를 위해 문학적 상상력과 공상이 동원되어야 한다. <시적 정의>는 공리주의 적 프루덴시아의 법학을 감성적・도덕적 프로네시스의 법학으로 보완하고자 한 다. 자로 잰 듯한 기계적 판결, 노동자・도시빈민의 궁핍과 빈곤에 공감하지 못 하는 냉혹한 재판관들이 지배하는 세상에서 이런 이야기를 만나는 것은 얼마나 반가운가. 다수의 서평이 <시적 정의>에 우호적이었던 데에는 이런 우리의 현 실과 무관하지 않으리라. 그러나 몇몇 사람들이 더 엄하게 처벌받거나 혹은 관 용적으로 처우 받는다고 해서 달라질 게 무엇인가? 정치사법과 계급사법, 그리 고 이를 지탱하는 법률의 정치적 편향성이 그로 존속한다면 말이다. 하나의 제도로서 법원은 결코 자기 스스로에 해 의심을 품지 않는다. 그것은 굳건한 하나의 관료조직이다. 몇몇 문학적 재판관들의 공감과 문학적 상상력에 기초한 판결만으로는 치유할 수 없는 고통이 만연한 세상, 우리는 이러한 시에 살고 있다. 이런 세상을 헤쳐 갈 힘은 문학적 재판관이 아니라 재판정에 출두해야 하는 중 자신에게서 나와야 한다. 때로는 반동적이기도 한 ‘위로부터 내려오는 정의’가 아니라 중 스스로의 힘으로 만들어가는 정치의 ‘마술적(=문학적)’ 가능성에 주목해야 한다. 시적 정의는 시적 정치로 나아가야 한다. 법에 한 문학의 자극은 그런 것이어야 한다. 왜냐하면 문학은 교조적인 것에 반하며, 시착오와 잘못된 금기 그리고 의미가 다 빠져버린 상징을 ‘낯설게 하는’ 아주 중요한 장치이기 때문이다.

Applying Legal Imagination and Fancy - Review of Martha Nussbaum’s “Poetic Justice”

What dominates today’s legal research and application is a positivist attitude towards statutes and decisions. Lawyers who are ‘expert fools’ wander in front of the law, hesitant to look beyond the strict boundaries of the law. The emergence of law schools as professional vocational schools has only intensified this tendency. This paper is a review of the Martha Nussbaum’s seminal piece, Poetic Justice. Nussbaum proposes an attitude towards statutory interpretation that not only utilizes technical rationality, but reasonable emotions. She contends that legal analysis must also be a literary/poetic judgment, which requires literary imagination and fancy. Poetic Justice seeks to supplement the utilitarian prudentia’s legal studies with emotional/moral phronesis. I welcome her suggestion in today’s context where coldblooded judges fail to empathize with the worker’s and the urban poor’s poverty and deprivation, engaging only in mechanical conclusions. Many commentators have embraced Nussbaum’s work for similar reasons. However, what difference does it make that some individuals are punished more severely while others are treated more generously, if the political biases that sustain the systematic injustices in dealing with a politicized and stratified legal system. As an institution, the court is never self-introspective; it is a solid bureaucracy. We live in an era where so much suffering, which the empathy of some literary judges and judgments based on their imagination cannot heal, is rampant. The breakthrough will not come from the literary

judge, but the public itself. The magical (literary) possibility of politics that are shaped by the masses must receive more attention than the sometimes reactionary “justice from above.” In other words, poetic justice must move as poetic politics. Literature’s influence on the law must be as such, since literature is an extremely important device that challenges and “makes strange” the dogmatic thinking, anachronism, irrational taboos and meaningless symbols that are prevalent in today’s world.
