<국문초록>

본 논문의 주제는 퇴행적 법치주의의 형태로서 법질서정치와 탈민주화 현 상 속에서 나타나는 행정적 폭력, 그 중에서도 특히 경찰 공권력의 폭력적 남 용 문제다. 한국사회에서 민주화 이후에도 여전히 경찰 공권력이 흉포한 이유에 대한 답은 퇴행적 법치주의로서 법질서정치 현상과 탈민주화 현상에서 찾아볼 수 있다. 법질서정치는 안전, 질서, 공익의 가치를 내세우지만, 실제로는 시민의 인권을 침해함으로써 퇴행적 법치주의의 또 다른 측면을 보여준다. 또한 국가 권력의 법치주의적 제한과 인권 보장이라는 민주화 성과는 장기적 과정의 산 물이지만, 탈민주화의 과정에서는 경찰 공권력이 흉포해 지면서 민주화의 성 과를 위태롭게 한다. 경찰공권력의 불법남용에 대한 통제는 민주주의와 법치 주의의 당연하고 확정적인 결과가 아니다. 민주주의와 법치주의의 퇴행을 막 기 위한 지속적인 노력이 필요하다. 법치주의의 퇴행과 탈민주화가 진행되는 가운데 ‘고립된 곳’에서, 경찰의 공권력은 흉포화된다. 경찰의 흉포성에 대한 일상적 경험은 더욱 고립과 무력 감을 늘려 법치주의 퇴행과 탈민주화의 가속을 초래한다. 현 시기 경찰 공권 력의 흉포화 지점이야말로 법치주의의 퇴행과 민주주의의 이탈을 목격할 수 있는 문제장소다. 동시에 탈민주화의 진행을 역전시키고, 민주화를 재진전시켜 야 할 출발점이다.

<Abstract> Law & Order Politics・De-democratization and Police Brutality

This essay deals with the abuse of police powers in the process of democratization and/or de-democratization in South Korea. Korean society has achieved both rule of law and democracy after long struggles for civil liberties against dictatorship, but still witnesses police brutality at the scene of civil demonstration and labor disputes. Law and Order politics as a distortion of rule of law, and de-democratization in high capacity state would be the key to understand the question of police brutality in a democratized society. Law and Order politics exploits people’s demands on security by strict criminal justice and criminal penalties, which are ineffective in addressing systemic causes of crime. This brings arbitrary and excessive use of police powers, which violate human rights of the minority under the name of law and order. Charles Tilly claims that democracy is not a secure place into which people can retreat from the political conflicts. According to his historical research of democracy, most regimes that have taken significant steps toward democracy over the last two centuries have later de-democratized at least temporarily. Only positive changes in trust-network integration, inequality insulation, and internal transformations of public politics secures effective and durable democracy. Those ideas of Law and Order politics and de-democratization explain the recent history of Korean democracy since the year of 1987.

Control of police power abuse is not the natural outcome of democratization, but a laborous task we keep working against the state power. The containment strategy of the police isolated individuals and groups who must have been protected by democratic politics and law. Where isolated, the ousted from their house, work or farm will be the target of the police brutality.
