<국문초록>


이 글은 일본정부가 일본군‘위안부’ 문제에 대한 법적 책임을 지속적으로 부정하고 있는 것을 문제상황으로 설정하고 일본의 법적 책임을 묻는다는 것이 갖는 의미를 비판적으로 검토하기 위하여 먼저 책임에 관한 근대법의 논리와 이를 수정, 보완하는 ‘피해자의 배상을 받을 권리’가 요구하는 기준을 살펴본다. 또한 일본군‘위안부’ 문제의 성격이 갖는 역사성에 대한 이해가 책임의 실현문제, 즉 배상의 구체적인 내용과 결부되어 있음을 고찰한 다음 1965년 청구권협정이 이 문제를 다룬 것이 아님을 밝히고, 국가의 청구권과 개인의 청구권을 이분하여 접근하는 한·일 양국정부의 입장을 비판하고 피해자의 권리의 측면에서 새롭게 해결책이 모색되어야 함을 주장한다. 일본군‘위안부’ 문제의 법적 성격은 그 동안 전쟁범죄 또는 인도에 반하는 범죄의 하나로 파악되고 여성에 대한 폭력 문제로 이해되어 가부장제 등이 그 원인으로 지적되고 있으나 일제강점이라는 식민주의와 제국주의전쟁이라는 맥락에서 자행된 것이라는 점도 고려한다면 민족문제가 여전히 과제로 부각된다. 일본군‘위안부’ 문제가 인종주의와 여성차별주의의 교착이라는 점에서 민족차별의 특수성은 인종차별과 여성차별이라는 보편성 속에서 접근될 수 있다. 일제강점 가운데 일본의 제국주의전쟁에 강제동원되어 일본군의 성노예가 된 일본군‘위안부’ 피해자들의 고통에 대한 법적 대응은 국가와 국가, 국가와 개인을 나누는 근대법의 전제에서 벗어나 피해자의 권리를 인권과 공동체적 관점에서 구현해 나가야 한다는 규범적인 요청 속에서 이루어져야 할 것이다.

<Abstract>


History and Legal Responsibility in the Japanese Military ‘Comfort Women’ Issue

This article examines critically the meaning of asserting legal responsibility of the Japanese government for the Japanese military ‘comfort women’ issue. It reviews the principles on responsibility in the modern law in the light of the international standards on the rights of victims to reparation which purport to modify and supplement the modern law principles. Considering also the connection between the historicity of the Japanese military ‘comfort women’ issue and the realization of responsibility, i. e. the concrete contents of reparation, the 1965 Claims Agreement between South Korea and Japan cannot be said to have solved the issue. The approach of the Agreement based upon the dichotomy between claims of States and those of individuals is problematic, and the ‘comfort women’ issue, among others, should be addressed anew from the perspective of victims’ human rights. While the legal character of the Japanese military ‘comfort women’ issue has been understood as constituting war crimes and/or crimes against humanity having the patriarchal system as its primal cause, the historical context of the colonialism, the forced occupation of Korean by the imperialist Japan, and the imperialist war should not be overlooked. The specificity of national discrimination against ‘comfort women’ under the Japanese colonial rule who had been subjected to yet another sexual slavery during Japan’s imperialist wars may be interpreted as a mixture of racial and sexual discrimination at the universal level. Legal responses to the sufferings of these victims are to be made under the normative requirement that victims’ rights and communitarian perspectives should be observed beyond the modern law premises maintaining a narrow division between States and individuals.
