<국문초록>


동티모르는 역사적으로 식민지 약탈을 본질로 하는 포르투갈의 식민주의의 논리, 일본의 제국주의 논리, 냉전시대에 미국을 배후로 인도네시아가 내세웠던 반공논리에 희생을 당한 지역이다. 동티모르는 어둠의 논리에 의하여 야기된 폭력적 과거와 1999년 대량학살사건의 후유증을 치유하고 정상적인 국가를 수립하기 위해 중대범죄특별법정과 진실 및 화해위원회와 같은 다양한 혼합적 법정을 구성하였고, 가해국가인 인도네시아와 함께 구성한 진실과 우호위원회를 통하여 2008년에 최종적 진실을 밝히는 보고서를 채택하였다.

이 글은 동티모르의 과거사청산 사례를 통해서 식민지에서 해방된 사회 또는 심각한 갈등과 분쟁을 겪고 난 사회에서 공동체사회의 재건을 위한 정의 실현이 어떠한 정의의 개념에 근거하여 제도를 수립하고 운영할 것을 요구하는가를 살펴보았다. 식민피지배역사와 반공논리의 희생양의 역사라는, 우리와 공통의 역사를 가지고 있는 동티모르가 이행기의 정의에 기초하여 추구한 과거사청산을 위한 노력은 일제에 의한 강제병합 100년이 지나도록 제대로 정립된 정의의 개념에 기초하여 과거사청산을 하지 못한 채 곪은 상처를 안고 사는 우리 사회와 정상적이지 않은 한일관계의 해소를 위한 새로운 논의의 기초를 제공할 수 있을 것이다.

Elimination of Colonial Rule and Transitional Justice: A Case of East Timor

This article examines the post-colonial justice system of Timor Leste, generally known as East Timor. East Timor experienced Portuguese colonial rule, Japanese imperialism, and Indonesian military occupation. In 1999, after decades of Indonesian occupation, the people of Timor Leste finally voted for their country’s independence in an UN-administered referendum. Upon announcement of the referendum’s results, serious violence took place in the country, resulting in massacres and forced deportations orchestrated by Indonesian military, police, and militia forces. In response to the violence, East Timor government established three hybrid tribunals: the Special Panels for Serious Crimes(SPSC); Commission for Reception, Truth and Reconciliation in Timor(CAVR); and Commission on Truth and Friendship(CTF). The first two hybrid tribunals were a unique two-track post-colonial and post-conflict justice system based on the transitional justice that simultaneously delivers both criminal and reconciliatory justice for crimes committed during Indonesian occupation. CTF was the first commission created by two countries related to colonial rule and published final report “Per Memoriam ad Spem”(From Memory to Hope) in 2008.

This article shows that hybrid tribunals may assist the process of healing both victims and communities and restore justice in post-colonial society. So, the hybrid tribunals and transitional justice will be helpful to start new discourses for the elimination of the  colonial rule in Korea and prosecution of the serious human rights crimes committed by Japan during 1910-1945.
