<국문초록>

 

항소심에서 강요죄 및 공갈죄로 유죄판결을 받은 이 사건은 한 인터넷 카페 회원들이 조선일보 등 언론사의 왜곡보도를 시정하기 위하여 광고주에 대해 불매운동을 고지하고 불매운동 철회의 조건으로 타 신문사들에 대한 동등한 광고게재 및 자사 인터넷 홈페이지 팝업창 게시를 요구한 것이 문제가 되었다.

필자는 불매운동은 상품의 소비자의 청약을 거절할 자유의 행사이며 판매자가 소비자의 청약에 대하여 갖는 기대는 법적 보호를 받을 계약 이전의 단계에 있으므로 소비자가 불매의 권리를 집단적으로 행사하였다고 하여, 그로써 판매자의 영업의 자유나 의사결정의 자유가 침해되었다고 할 수 없다고 판단하였다. 즉, 협박의 구성요건해당성을 인정할 수 없다는 것이다. 다른 모든 논점은 적어도 본 사건과 관련해서는 필자의 입장에서는 불필요한 것이었다.

그 외에도 강요죄의 정당행위 해당 여부의 판단을 위해 항소심이 사용한 ‘방법의 적절성’ 기준은 지나치게 엄격하였다는 점, ‘최후수단성’ 기준은 적용 자체가 부당한 것이었다는 점을 논했다. 방법의 적절성은 실효적 기여의 의미로만 이해되어야 하고 항소심에서와 같이 직접적 관련성을 요구하는 것으로 이해되어서는 안 된다. 또한 학계 일각에서 제기되는 ‘내적 관련성’ 기준 역시 모호하고 부당한 결과를 낳는 경우가 있어 경계하고자 하였다. ‘최후수단성’ 기준은 권리 또는 기본권 충돌이 문제되는 사례에서는 정당행위 심사기준이 될 수 없다고 보았다.

방법적 측면에서 2차불매운동은 1차상품에 대한 소비자의 권리가 2차상품에 대해 갖는 불가결한 관련성, 특히 신문과 같은 상품에서 두드러지는 그 특성 때문에, 그리고 기업의 사회적 책임 때문에 본질적으로 1차불매운동과 다를 바가 없어서 1차불매운동의 적법성이 승인되는 한 2차불매운동이 달리 취급될 이유가 없음을 설명하고자 하였다.

A Criticism on Punishing Consumers for Criminal Coercion for Noticing Boycott to Newspaper Advertisers

 

Some netizens requested a medicine company not to advertise on some newspapers which were reporting unjustly and wrongly about government’s importing mad-cow policies. The netizens warned a boycott when it continued advertising that way. The company did not stopped but accepted the alternative which the netizens offered to advertise on the other newspapers relatively fairly reporting on mad-cow issues. The courts of first instance and of appeals found the netizens guilty for the crime of ‘coercion’ and ‘blackmailing’ (Criminal Law §324 and §350).

The judgements are wrong for the following reasons. Firstly, there was no compulsion in that there was no infringement on any other’s freedom. Boycott means mear refusal of subscription which is left to the buyer’s discretion. Because a simple subscription does not give the other party any expectation of profits therefrom, the refusal of it does not infringe on her/his freedom of business. Secondly, the ‘last-resort principle’ should not have been applied to this case since it is a principle to regulate government’s restrictive actions on basic rights and not to restrain a citizen from carrying out such action. Thirdly, as far as such a demand on the advertisers had been found justifiable, the means of boycotting also should have been found relevant for that aim because it is an apparently effective method. The court of appeal thought that ‘the relevant method rule’ would require a ‘direct’ relation between means and ends. But there has been no similar case such this as requiring ‘directness’ as to exercising fundamental rights. Eventually, the consumer right including that of boycott which is a constitutionally protected right, and should not be interrupted by the crimes of coercion and blackmail at Criminal Law.
