<국문초록>

 

이 논문의 일차적인 목적은 1987년 이후 20년간 한국의 인권상황을 개괄적으로 점검해 보는 것이다. 이를 위해 일반적인 분류에 따라 인권을 시민적․정치적 권리와 경제적․사회적 권리로 나누어 그 변화양상을 살펴보았다. 그리고 시기와 관련해서는 인권상황이 권력의 변화와 밀접히 연관된다는 측면에서 크게 1987년 이후의 10년간과 그 이후의 10년으로 나누어 검토하였다. 나아가 특히 후자에 대해서는 새로이 등장한 인권문제인 소수자의 인권, 과거청산, 그리고 국가인권위원회의 문제도 추가로 살펴보았다.

이러한 검토를 바탕으로 한 한국의 인권상황 및 인권운동에 대한 필자의 진단은 다음과 같다. 정치적 권리로 대표되는 자유권 분야에서 한국의 인권은 1987년 이후 10여년간 별다른 개선이 없었지만, 최근 몇 년간에는 일정한 진전이 있었다고 볼 수 있다. 그러나 사회적 권리와 같은 생존권 분야에서 인권상황은 정체 내지는 지속적으로 악화되었으며, 이러한 문제는 특히 최근에 와서 양극화와 빈곤이 고착화되는 양상으로 더욱 심각해지고 있다. 한편 이러한 변화에 대응하여 인권운동은 원래 개인주의와 자유주의를 바탕으로 했던 서구 인권의 개념을 사회권 및 생존권 중심으로 파악하고 그 개선을 위하여 집중하는 노력을 하고 있으며, 이것은 현재 한국사회의 인권문제를 올바르게 인식하고 대응하는 것이라고 평가할 만 하다.

<Abstract>

 

1987-2007 Human Rights and Human Rights Movement in Korea

In this essay, I want first of all to depict the changes of Human Rights in Korea over the recent 20 years since 1987, when a big political movement happened. For this purpose I divided Human Rights into two realms, Civil/Political Rights and Economic/Social Rights. Next, I split the time interval into two phases, 1988-1997 and 1998-2007, because Human Rights is closely related with the characteristics of the administration itself. Moreover, for the second phase I add other Human Rights issues: Minority Right, Transitional Justice, and the National Human Rights Commission of Korea.

Based on this analysis I would mention Korean Human Rights and Human Rights Movement as follows:

In terms of Civil Rights, for a decade after 1987 we cannot find any meaningful changes, but the next decade there have been some considerable improvements. Economic Rights, however, have been consistent or got worse, considering the recently deepened polarization between the rich and the poor. In response to this change, on the other hand, Human Rights Movement has been trying to review the concept of Human Rights, focusing on Economic/Social Rights. And the same may be said of the practical field. I conclude, finally, this understanding and practice is quite correct and hopeful for the future of Korea.
